The Menendez brothers are expected to face freedom after their resentencing on Tuesday, May 13,2025.
Before getting into what will happen to them, here is a little background about them if you don’t already know. Erik and Lyle Menendez have spent more than three decades behind bars for killing their parents, Kitty and Jose Menendez, inside their Beverly Hills home in 1989 for abusing and sexually assaulting them. After two trials, a Los Angeles County judge sentenced them to serve life in prison, without the possibility of parole.
On Tuesday, many things have been said that made the brothers a huge step closer to freedom. The judge gave a chance to the brothers that they could leave the Southern California prison where they’re incarcerated.
Scheduled for June 13, Jesic’s ruling allows Erik, 54, and Lyle, 57, to make their case for freedom at a hearing aimed at determining whether they’re suitable for parole.
A lawyer for the brothers, Mark Geragos, has downplayed the violations, which include using smuggled cellphones after the resentencing proceedings were initiated, and said they do not constitute a “super strike,” or the kind of serious crime that could suggest they pose an unreasonable risk.
If the brothers get denied or granted parole, they could lobby for their freedom again in future meetings with the board. However, it may take a few years before their next appointment.
If the panel denies an inmate parole, state law requires the board to schedule another hearing three, five, seven, 10 or 15 years in the future, according to the California Department of Corrections and Rehabilitation.
If Erik or Lyle is granted parole, the board and the governor will review the panel’s decision. Ultimately, Newsom has the final decision to approve or deny the brothers’ freedom.
